Welcome to 'MERICA LLC ("Company," "we," "us," or "our"). These Legal, Product Use & Compliance Terms apply to all hemp-derived CBD, CBG, CBN, and THC products, services, content, purchases, and transactions conducted through this website.
By accessing this website or purchasing any CBD, hemp, or THC product from us, you acknowledge that you have read, understood, and agree to these terms.
1. IMPORTANT PRODUCT-USE NOTICE
Our CBD, CBG, and CBN products are derived from hemp containing no more than 0.3% Delta-9 THC by dry weight, consistent with the 2018 Farm Bill (Agriculture Improvement Act of 2018). Where a product contains hemp-derived Delta-9 THC, it is formulated to remain within that legal limit.

8. JURISDICTIONAL RESTRICTIONS

The customer is solely responsible for determining whether the purchase, possession, receipt, and intended use of a particular product is lawful where the customer lives.
We reserve the right to restrict or refuse sales and shipments to any state, territory, country, municipality, or other jurisdiction where these products are restricted or prohibited.
9. SHIPPING & ORDER REVIEW
We reserve the right to refuse, cancel, or refund an order when the product is prohibited or restricted in the destination jurisdiction, when we cannot verify a customer meets the age requirement, when applicable law is unclear or changing, or when we reasonably believe the transaction could expose the Company to legal or regulatory risk. If an order is canceled for these reasons, we will issue a refund to the original payment method.
10. THIRD-PARTY SUPPLIERS
'MERICA LLC may sell CBD, hemp, and THC products manufactured, packaged, or supplied by independent third parties and cGMP-certified facilities. The Company may rely upon product information, specifications, lab results, and compliance materials supplied by those manufacturers.
11. PRODUCT SAFETY
Keep all CBD, hemp, and THC products out of reach of children and pets. Do not drive or operate heavy machinery until you understand how a product affects you. Follow all dosage guidance printed on product labeling; do not exceed the recommended serving size.
12. CUSTOMER INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless 'MERICA LLC, its owners, officers, employees, contractors, agents, suppliers, and service providers from claims, damages, liabilities, losses, costs, expenses, and reasonable attorneys' fees arising from or relating to your unlawful use of a product, your violation of these terms, or your violation of applicable law.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, 'MERICA LLC shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from a customer's improper, unintended, or unauthorized use of a product.
14. CHANGES IN LAW OR PRODUCT LINEUP
'MERICA LLC reserves the right to immediately modify, restrict, discontinue, or remove products or shipping destinations when necessary to respond to changes in law, regulatory guidance, or business needs.
15. SEVERABILITY
If any provision of these terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
16. GOVERNING LAW
These terms shall be interpreted and enforced in accordance with the laws of Massachusetts, without regard to conflict-of-law principles, except where applicable law requires otherwise.
17. ENTIRE AGREEMENT
These terms, together with our Privacy Policy, Shipping Policy, Refund Policy, Terms of Service, and any product-specific terms, constitute the applicable terms governing purchases made through this website.
